Customer Account Portal (“CAP”)
Terms of Use
You are registering with this Customer Account Portal (“CAP” or “Portal”) to access services related to your utility account, including bill payments, obtaining reports and data, and other business services offered through this Portal.
This Agreement is between Prithibi LLC and GSWC, (collectively the “Provider”), and the entity or individual (“you” or “user”) registering to access the CAP, and describes the terms and conditions for the use (“Terms of Use”) of the CAP. If you have any questions, please contact Provider by email at customerservice@gswater.com or by telephone at (800) 999-4033, before agreeing to the Terms of Use.
If you do not agree to these Terms of Use, you may not access the CAP. In such case you should contact Provider for alternative options to access your account.

Authorized User:
You represent that you are the account holder on record for this CAP or an authorized representative of such person or entity and you are 18 years of age, or older, and that you accept this Terms of Use.

Consent to Usage of Data:
Any information you enter into the CAP to access your account will be transmitted to a third-party payment processor for the purpose of payment processing. You consent and authorize such use of your data and such data may include financial, sensitive, or confidential information. Provider will not store any data entered into the CAP.

User Responsibilities and Warranties:
Data Protection: Provider will take commercially reasonable measures as we deem appropriate to secure and protect information transmitted to and from the CAP. Nevertheless, we cannot and do not guarantee that any such transmissions, or that transactions conducted on or through the CAP, are or will be totally secure. You are responsible for maintaining the confidentiality of your account and account number and any other user identifier or other unique name or number identifying you and any password used in connection with your use of the CAP, and you are fully responsible for all access and any activity that occurs through use of your User ID or password. If you choose to make online payments using the Portal, your financial information will be processed by a third-party payment processor. You are responsible for protecting the security of your information sent or received from the CAP and should take reasonable steps to protect the information you choose to share from improper disclosure.
Provider will not be liable for the safety and protection of your data.
Accuracy of Information: You are responsible for the accuracy of any information entered into the CAP. Provider is not responsible for any error in the services obtained through the CAP as a result of inaccurate data entered.
You agree that you will not use the CAP and any services provided herein, directly or indirectly, for any fraudulent undertaking or other illegal activity, and that you will comply with all applicable laws, policies, guidelines, regulations, ordinances, or rules.

Suspicion of Illegal Activity:
Provider may terminate your access and registration at any time for any reason with thirty (30) calendar days’ notice. Provider may suspend your access to the CAP immediately, if Provider reasonably suspects a risk associated with your account due to fraud or other illegal activity, or if you violate any term of this Terms of Use.

Warranties:
Although Provider strives to make content, features, materials, and services provided through the CAP reasonably helpful, useful, reliable, and current, you understand and agree that your access to and use of the CAP are at your own initiative and risk.
No Warranties: The CAP and all associated software, functions, and applications are provided on an “AS IS” and “AS AVAILABLE” basis. Provider does not warrant that the CAP will be timely, secure, uninterrupted, or free of errors, defects, or viruses.
Provider makes no express or implied warranties regarding the Service, including without limitation the implied warranties of merchantability and fitness for a particular purpose.

Limitation of Liability:
In no event shall Provider be liable for any lost profits, loss of data, or any indirect, punitive, incidental, special, consequential, or exemplary damages arising out of, in connection with or relating to this Terms of Use or the CAP, including without limitation the use of, inability to use, or unavailability of the CAP.
Under no circumstances will Provider be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the CAP.
Provider assumes no liability or responsibility for any injury or damage to person or property, of any kind, resulting from your access to or use of the CAP.
Provider assumes no liability or responsibility for any interruption or cessation of transmission to or from the CAP; for any software bugs, viruses, trojan horses, or other harmful code that may inadvertently be transmitted through the use of CAP, or for any loss or damage incurred as a result of your use of the CAP.

Indemnification:
You agree to indemnify and hold harmless Provider from any and all claims arising out of your usage of the CAP, unless caused by Provider’s gross negligence or intentional misconduct.

Amendments:
Provider reserves the right to amend this Terms of Use at any time, and to change, add, or omit features to the CAP with reasonable notice. Your continued usage of the CAP thereafter will be deemed acceptance of such changes. If you do not agree to the amendments to these Terms of Use, you may not access the CAP. In such case you should contact Provider for alternative options to access your account.

Governing Law:
This Terms of Use shall be governed by the laws of the State of California, without regard to the choice of law or conflict of law provisions. Both parties hereby irrevocably waive their right to a trial by jury in any judicial proceeding involving a claim arising under this Terms of Use.

E-Billing:
Customers enrolling in the customer account portal (CAP) will be automatically enrolled in paperless billing ( e-billing).
