E-Billing Terms and Conditions

  1. Acceptance of Terms and Conditions
    By participating in the e-Billing option of Golden State Water Company(“Utility Company”), you agree to be bound by the terms and conditions stated below.
  2. Electronic Bill Presentment – Replacement of Paper Bill
    If you choose to receive an eBill, you no longer will receive a paper bill. When a new eBill is available, you will receive an e-mail notification, containing a link to view your eBill. Utility Company will attempt to present your eBill notification promptly; however, it is your sole responsibility to provide a current e-mail address for bill notification purposes. You must contact Utility Company at 1.800.999.4033. if you cannot access your bill online. It also is your sole responsibility to ensure timely payment of all utility bills. Contact Utility Company at customerservice@gswater.com for additional information about your bills.
  3. Fees and Charges
    Utility Company does not charge a fee for eBill. We reserve the right to impose fees and/or charges in the future. In that event, you will be notified in advance, but any use after notification will constitute your agreement to pay the fee. Any fees imposed by your financial institution are your sole responsibility. You also are responsible for any and all telephone access fees and for Internet service fees that may be assessed by your Internet service provider.
  4. Changes in Your Information
    It is your sole responsibility to ensure that your contact and account information, including but not limited to your name, address, phone number and e-mail address, remain current and accurate. You must contact Utility Company to update this information if it changes.
  5. Errors and Questions
    Contact Utility Company at 1.800.999.4033 or by e-mail at customerservice@gswater.com to report errors in your eBill or electronic payment transaction(s), or to ask questions about your online account.
  6. Disputes
    In the event of a dispute, you agree to resolve that dispute according to these Terms and Conditions.
  7. Disclaimer of Warranties
    YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

    YOUR USE OF UTILITY COMPANY’S ELECTRONIC BILLING OPTION (“THE SERVICE”) IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN “AS-IS” AND “AS-AVAILABLE” BASIS. UTILITY COMPANY EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NONINFRINGEMENT.

    YOU FURTHER EXPRESSLY UNDERSTAND AND AGREE THAT UTILITY COMPANY DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS, OR THAT THE SERVICE OR THE INFORMATION PROVIDED BY THE SERVICE WILL BE ERROR-FREE. UTILITY COMPANY DOES NOT WARRANT THAT THE SERVICE WILL FUNCTION PROPERLY IN COMBINATION WITH YOUR EQUIPMENT, OR THAT THE FILES, CONTENT, AND/OR OTHER INFORMATION, IF ANY, ACCESSED OR DOWNLOADED FROM THE SERVICE WILL BE FREE FROM INFECTION BY MALICIOUS OR DESTRUCTIVE CODE.
  8. Limitation of Remedies and Liability
    YOU AGREE THAT YOUR SOLE REMEDY ARISING FROM YOUR INABILITY TO USE OR ACCESS THE SERVICE, FROM DEFECTS IN THE SERVICE OR UTILITY COMPANY’S WEB SITE, OR FROM ANY OTHER MATTER ARISING FROM YOUR USE OF THE SERVICE OR THE WEB SITE, IS TO RECEIVE YOUR BILL. IN NO EVENT SHALL UTILITY COMPANY BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO, LOSS RESULTING FROM BUSINESS DISRUPTION, LOSS OF DATA, LOST PROFITS, LOST GOODWILL OR DAMAGE TO SYSTEMS OR DATA, WHETHER IN AN ACTION FOR CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EVEN IF UTILITY COMPANY HAS BEEN ADVISED OF THE POSSIBILITY THEREOF.
  9. Utility Company’s Reserved Rights
    In addition to all other rights to Utility Company hereunder, Utility Company reserves the right to terminate, cancel or modify, in whole or in part, eBilling at any time and from time to time, in its sole discretion.
  10. Entire Agreement
    You agree that these Terms and Conditions are the complete and exclusive statement of the services to be provided, that they supersede any prior agreement, and that they can be modified only in writing. These Terms and Conditions may not be modified or altered verbally by any Utility Company employee or representative
